Bank of America was hit with a class action suit in California earlier this week charging that the company is liable for identity theft and fraud in the aftermath of a 2012 data breach, according to documents filed in the California Superior Court, County of Los Angeles, and reported on by Law360.
The suit alleges that the personal information of customers, such as names, Social Security numbers and account numbers, was accessed, stolen and sold to third parties.
Bank of America discovered the breach in March 2012, according to a Bank Information Security report. In court documents lead plaintiff Andrew King said the bank notified him but despite freezing his credit reports and issuing fraud alerts he still was a victim of fraud and identity theft, including having a loan issued in his name.
