Target asks court to stay discovery

Target has asked a federal court in Minnesota to stay discovery in a class-action lawsuit pertaining to its December data breach until another court determines in October whether all or many of the complaints will be dismissed.

In a motion to stay, Target contended that it “has a substantial likelihood of succeeding in seeking dismissal” of the bulk of the complaints in the consolidated suit. In late June the court had begun Pretrial Scheduling Orders to address Target's motions to dismiss consolidated complaint in both the financial institution and consumer cases.

Citing the “burden” on the litigants and the court “that discovery regarding potentially moot questions would impose,” Target requested relief until the motions to dismiss are resolved.

The breach exposed consumer data and eventually prompted a restructuring of the retailer's security and executive branches.
