A Federal Court of Appeal in Canada ruled that students whose student loan information was exposed in a 2013 data breach now have more options to recover damages in a class action lawsuit.
The students had sued the Canada Student Loans Program for losing a portable hard drive containing personal information of 583,0000 students.
Last week, the appeal court overturned a decision that limited the legal arguments students could use to pursue their case. The original decision had said the students couldn't prove they suffered certain damages as a result of the breach but has since been changed to say that because of the government's negligence the students didn't need to prove damages to proceed, according to CBCNews.
The students are also suing for a breach of contract and what amounts to the Canadian equivalent of invasion of privacy.
