Administrative trial against LabMD to begin next week

A federal district court judge has ruled not to dismiss the administrative trial proceedings regarding the ongoing court battle between the Federal Trade Commission (FTC) and LabMD.

On Monday Judge William Duffey of the U.S. District Court for the Northern District of Georgia dismissed two motions filed by the now defunct Atlanta-based company filed, according to court documents.

Now the medical testing lab will have to face administrative action from the agency, as well as participate in the administrative hearing that will delve into the company's data security practices. The trial begins on May 20.

This is a step back for LabMD just days after an administrative law judge backed the company's argument that the FTC should reveal the data security standards the agency intended to use to evaluate LabMD's security practices.
