The Federal Trade Commission (FTC) on Monday issued a request for public comment on its rule regarding Disposal of Consumer Report Information and Records, according to The Hill.
The solicitation is in keeping with its periodic reviews of its guidelines. This request seeks comment on a decade-old data protection mandate, The Disposal Rule, a segment of the Fair and Accurate Credit Transactions Act (FACTA), which mandates that before disposing of consumer reports, including credit and background checks, enterprises take "reasonable measures to protect against unauthorized access to or use of the information in connection with its disposal."
The FTC seeks feedback on what terms in the rule need updating or better defining (such as “consumer information"); what prescriptive requirements should be strengthened, weakened or removed; and comments on the costs of complying and whether greater specificity in disposal methods are needed.
Comments are due by November 21.
