Sen. Rand Paul joins bipartisan opposition to Rule 41 amendments

Sen. Rand Paul (R-Ky.) plans to join Sen. Ron Wyden (D-Ore.) in a bipartisan effort to introduce legislation to block proposed amendments to Rule 41.

Sen. Paul plans to be the first Republican co-sponsor of legislation to attempt to undo proposed amendments to government procedural rules for the U.S. court systems which would expand the powers of magistrate judges to issue warrants for remote access to computers located in any jurisdiction, the senator's office told Reuters on Thursday.

Magistrate judges usually only issue warrants within the jurisdiction of their court, which is typically limited to only a few counties.

The bipartisan opposition bill is planned to be introduced next week, Reuters said.

In a recent interview with SCMagazine.com, defense attorney Tor Ekeland told SCMagazine.com Rule 41 represents “the largest expansion of search and seizure powers in the history of the United States.”
